Customers seek refunds after fitness club fire
Nearly six months after arson destroyed a local fitness club, we finally know how customers can get their cash back.
"It's been very trying and very demanding. It's been rough," said Kevin Kaczmarek, the owner of the Grand Blanc Court and Fitness Center.
It's tough for him and tough for his customers.
"I'd just like my money back," said customer Pat Robinette. "It's not a lot of money, but still, it's my money and I have a right to it."
On Dec. 3, 2007, Robinette bought a three-month membership at the club in Grand Blanc Township.
"Brought it home, wrapped it up, put it under the Christmas tree, and even before Christmas, the place burned down."
The state fire marshal called it arson, and months later, the insurance company paid out $1.27 million.
"We have every intention on fully paying back anyone we owe," Kaczmarek said.
But when is still unclear.
"I've called at least ... probably eight times, just to the attorney's office, because I don't know how to contact the owner," Robinette said.
The building and the business may be gone, but the mortgage is not. The owner owes the bank about $500,000, and that's just the start.
"My clients are on the proceeds, the lawyers are on the proceeds. The county treasurer's office is on the proceeds. The demolition company was on the proceeds, so it's not like my client received a check to him and his wife," said Kaczmarek's lawyer Kyle Riem.
The owners did set aside a confidential amount to pay back customers.
Records that were lost in the fire will only make it tougher, but for those who copies of their records, the task will be a bit easier.
For Robinette, patience is wearing thin.
"I have tried since then to get a refund and have not been able to get any satisfaction," Robinette said.
